Information regarding the processing of personal data

Dear Applicant,
In Job S.p.A. wishes to inform you that your personal data will be processed in compliance with current legislation on the protection of personal data and in accordance with the information below.


1. Data Controller
The data controller is the company In Job Spa (hereinafter the "Data Controller" or the "Company") with registered office in Via Germania, 1, 37136 Verona (Italy), e-mail: info@injob.com.

2. Object of the processing
The processing concerns the personal data communicated by you on the occasion of your spontaneous application or following an announcement, such as: name and surname, date and place of birth, domicile, telephone and mobile phone number, tax code, e-mail address, information regarding your profession, employment status, qualifications, language skills, educational qualifications, possibly the image, and any other data on your CV (including photos).
We wish to inform you that when assessing applications we do not need to process any particular data, i.e. personal data revealing racial or ethnic origin, religious or philosophical beliefs, political opinions, trade union membership, genetic data, biometric data, data relating to health or sexual life or sexual orientation.
For this reason, please only provide us with the data required to evaluate your application and avoid entering data that is not relevant to the selection.
If, however, you consider it appropriate or necessary to indicate any of such particular data for a better evaluation of your application (for example, belonging to protected categories), we inform you that you must give your consent to the processing.
Any data relating to criminal convictions or offences (such as, for example, the criminal record and the certificate relating to pending charges) may be requested only where necessary according to the law in relation to the particular job position applied for.

3. Purpose and legal basis of the processing
Your personal data will be processed for:
a) offering you search and selection services aimed at establishing a work relationship with client companies, with our Company, or with companies in the group, also in administration. This includes: registration on our portal with the creation of your own personal profile; the possibility of applying for specific job postings following the selection process; the evaluation of your profile also for job positions other than those for which you submitted your application in the event of your profile being suitable and in line with what you are looking for; the management of the application through: (i) requesting references from any of your previous employers (resulting from your CV and provided that you no longer have a working relationship with them); (ii) sending, with access to the personal area of the web portal, questionnaires, for example, on your language skills or the possibility of taking optional aptitude tests (for which you will receive special information); (iii) sending job proposals in line with your profile; (iv) sending of your data to potential employers ("long list" and "profile", containing non-identifying data: age of the candidate; location of domicile; educational qualifications; professional experience; skills and competences); (v) the implementation of training courses if the requirements are met. The legal basis for the processing is


b) the execution of the contract or pre-contractual measures (art. 6, paragraph 1, letter b) of EU Regulation 2016/679 (the "Regulation"); consent is required for the processing of any relevant particular data (art. 9, paragraph 2, letter a) of the Regulation);
c) to comply with any specific obligations provided for by law or the regulations, or provisions issued by the authorities. The legal basis is the fulfilment of legal obligations (art. 6, paragraph 1, letter c) of the Regulation);
d) to send you promotional communications by e-mail, concerning services, offers, as well as events organised by the Company, group companies or business partners. The legal basis for the processing is consent (art. 6, paragraph 1, letter a) of the Regulation);
e) to use your image and voice, acquired through the recording of video interviews in the personal area of our portal, in order to send it to clients interested in your profile, for the formulation of offers and promotion of your application to such client companies or potential clients. The legal basis for the processing is consent (art. 6, paragraph 1, letter a) of the Regulation);
f) to ascertain, exercise or defend a right of the Data Controller in disputes arising in connection with the services offered. In this case the Data Controller will pursue this purpose further, where necessary, by processing the data collected for the above purposes (the legal basis is art. 6, paragraph 1, letter f) of the Regulation and for particular data, art. 9, paragraph 2, letter f) of the Regulation.

4. Methods of processing through the platform
The Data Controller provides applicants with a portal via which they can create their own profile, apply for specific job positions, record video interviews, and interact with recruiters.
To apply for a specific vacancy or submit a spontaneous application, it is necessary to create a user profile on the portal.
The portal is assisted by suitable security measures that guarantee the confidentiality, integrity, and availability of the data.
We ask our applicants to carefully safeguard their credentials for accessing the portal, in particular the password selected. We must remind you that the access credentials are for the exclusive personal use of the registered applicant.
We would like to inform you that during the search and selection activity we may use an advanced automated system that allows us to search, through keywords, the applications present in our database in line with the job profile applied for and to give an evaluation of the same.
It is therefore a filtered search in the information provided by applicants, based on parameters such as skills, training, job title, and availability, which identifies a list of profiles compatible with the job position.
This is only an automatic first scoring as there is always human intervention by recruiters to evaluate further profiles.
This system allows us to optimise and make the selection process more efficient, offering a cutting-edge service to applicants and our clients.

5. Provision of data and consequences in case of failure to provide data
The provision of data for the purposes referred to in letters a) and b) of paragraph 3 is mandatory and failure to provide them will make it impossible to obtain our services. If you have also indicated particular data, because they are considered necessary for a better evaluation of your application, the issuance of consent is mandatory and, failing this, we will not be able to consider them.
The provision of data for the purposes referred to in letters c) and d) is optional and may be modified at any time. Failure to provide your data will make it impossible to keep up to date with new events or offers (letter c) or to promote your application by video interview (letter d).

6. Recipients of the data
The data may be made accessible, brought to the attention of, or otherwise communicated to the following parties:
• Employees and/or collaborators of the Data Controller adequately trained and authorised to process the data;
• Subjects, natural or legal persons, who and which the Data Controller avails of for the performance of its services (by way of example: suppliers of IT and application services, such as the application platform, e-mail marketing platforms, website managers, group companies involved in research and selection, etc.), who or which will process the data in their capacity as Data Processors;


• Subjects, public or private, to which or whom the Data Controller is required to communicate the data by virtue of obligations deriving from laws or regulations;
• Companies that are our clients/potential employers/user companies, exclusively within the scope of the research and selection of applications, and therefore for the purposes indicated in paragraph 3 letter a) and d). These subjects will process the data as independent data controllers.
• Your personal data will not be disclosed or disseminated.

7. Data transfer outside the European Union
For research and selection activities, the Data Controller also makes use of IJ USA Inc., a group company based in the USA, and we may also avail of other service providers operating outside the European Union.
We would like to point out that in this case the guarantees provided for in the Regulations are adopted. In particular, where there is no adequacy decision (art. 45 of the Regulation), our Company has prepared contractual instruments containing the standard contractual clauses approved by the European Commission (art. 46 of the Regulation).
You may request further information on the contractual clauses in use and/or a list of suppliers operating abroad from our Data Protection Manager at the address indicated in paragraph 10.

8. Period of data retention
Your personal data will be stored for a period of 24 (twenty-four) months after your online registration or your last activity (e.g. access to your personal area, updating or uploading CV) for the purposes set out in points a) and d) of paragraph 3. Within your personal area you can always delete your profile personally at any time.
For 24 months, data processed for direct marketing purposes, as per paragraph 3 letter c), will also be stored.
In the event that you manage to find employment through our services or participate in active employment policies, the Company will keep your data for a longer period of time (and in any case up to a maximum of 10 years after the end of the relationship) in compliance with any contractual and legal obligations in force.
In case of processing for the fulfilment of legal obligations (letter b) of paragraph 3), the data will be kept for the times established by the same laws.
For the purposes indicated in paragraph 3 letter e) the data will be processed for the time necessary to pursue the protection of our rights.

9. Rights of the data subject
In accordance with articles 15 and following of the Regulations you have the right to request, at any time, access to your personal data, rectification, and deleting of the same in the hypothesis of the art. 17, the restriction of the processing in the cases provided for in art. 18, and the obtaining of the data concerning you in a structured format of common use and readable by automatic device, in the cases provided for in art. 20 of the Regulation.
At any time you may revoke the consent given previously, and lodge a complaint with the Supervisory Authority for the protection of Personal Data if you believe that your rights have been violated, according to the procedures indicated on the website of the Supervisory Authority accessible at the address: www.garanteprivacy.it.
You may object to the processing in accordance with art. 21 of the Regulation highlighting the reasons justifying the objection.
If you wish to exercise any of these rights, please write to our Data Protection Officer at the address indicated in paragraph 10 below.
